When people are getting divorced, it is only natural that they have questions about the future of their children. You want to know what you can expect from your child support payment plan. When you step into our offices, we will answer your questions, help you understand the process, and let you know what you can expect.

How Child Support is Determined

In Illinois, child support is based on specific guidelines, determined by income. The paying parent is expected to devote a specific percentage of his or her income:

  • 1 Child - 20%
  • 2 Children - 28%
  • 3 Children - 32%
  • 4 Children - 40%

However, the courts can deviate up or down from these guidelines depending on specific circumstances. The courts consider the income of both parents, the cost of child care expenses, and whether or not the paying parent takes care of health insurance and other out-of-pocket expenses. An experienced attorney can make sure all factors are taken into fair consideration when determining a child support plan for your family. We can also help you file for child support modification if there has been a significant change to your or your former spouse's financial situation.

Orders for Support

The State of Illinois provides a method for withholding child support payments from the paying parent's paychecks. This ensures the recipient that they will receive timely and accurate support payments. It provides the paying parent with accurate and official documentation of all payments, so there are no disputes as to whether or not payments were made. We can help you obtain orders for support.
