Developing a Fair Plan for Alimony

When you get divorced, you have to be ready to make some major changes. It is important to remember that you can affect those changes and make sure they allow you the style of living that you have grown accustomed to. At the Hanover Park and Chicago Law Offices of Elliot Heidelberger, we represent spouses who are paying and spouses who are receiving alimony when they want to make sure their rights are being protected.

There are a lot of ways to come up with a fair plan for spousal support. We help our clients understand their options and try to find the most efficient path to a plan that meets their goals. One of the first things we do, before there is a trial or a hearing, is set up a four-way meeting between both parties and their attorneys. We also hold pretrial conferences where the lawyers meet with the judge to get recommendation as to how to come to a successful resolution. We take every effort to save our clients from the timely process of litigation, as long as we are able to negotiate a fair plan on their behalf.

Determining Alimony Payments

Unlike child support, there is no formula for alimony in Illinois. When there is a disproportionate ability to earn income, the courts can upset that disability, but the responsibility of determining a plan is most often settled through negotiation between the parties. There are a number of factors that affect the plan for spousal support in any divorce:

  • Child Support Payments
  • Length of Marriage
  • Age
  • Job Experience
  • Education
  • Health

In cases involving children, the courts also compensate the stay-at-home parent for giving time to raise the children and not being in the job market.

Modification

Alimony plans can last for a limited time or for life. However, it is important to remember that they can change. If there has been a significant change in the earning capacity or overall financial status of you or your former spouse, you can request a modification. We can answer all your questions about modification and make sure the plan you have is still protecting your rights.
